Terms of Service

These Terms of Service ("Terms") govern your use of Charmly (the "Service"), an AI profile photo generation service. By using the Service you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. Users under 18 must have a parent or guardian's consent.

2. Account

You sign in with a Google account. You are responsible for keeping your account credentials secure and for all activity under your account.

3. Credits and Pricing

  • Monthly subscriptions renew automatically on the subscription’s monthly anniversary at the price shown at checkout. Where that date does not exist, renewal falls on the last day of the month. Each paid period provides four equal automatic credit grants: at its start and 7, 14 and 21 days later. One credit = one generated image.
  • A first-time 7-day trial includes 12 photos with a payment card. It automatically becomes Standard at $12.99/month after 7 days; cancel before trial end to avoid a charge. Trial credits expire at trial end.
  • Daily generation limit: 100 images per user.
  • If a generation fails (API error, content policy rejection, etc.), the credit is automatically refunded.
  • Prices are listed on the pricing page, tax inclusive.

4. Payments and Refunds

  • Cancel anytime through your account’s billing portal. Cancellation stops renewal at the end of the paid period. Monthly photos expire 30 days after their corresponding paid period ends; cancellation does not stop that period’s remaining grants, and renewal does not extend earlier expiry dates. One-time pack credits expire 6 months after purchase; balances previously sold without expiry retain unlimited validity. Expiry dates appear in your account.
  • Automatic credit grants require payment for the corresponding period. No claim action is needed.
  • Signed-in members may buy one-time packs of 24 credits for $4.99, 60 credits for $11.99, 120 credits for $21.99, with or without a subscription. Pack credits expire 6 months after purchase (on the same day of that month, or its last day if that day does not exist). Packs do not renew automatically and do not change a subscription's renewal date.
  • Payments are processed by Stripe. We do not store your card details.
  • Because credits are digital and immediately usable, we generally do not provide refunds after purchase. We will consider individual cases where the Service has materially failed to function.

What happens when I change, rejoin or cancel a plan?

Upgrade

After successful payment, your old plan ends and a new month begins at the full new monthly price, with no proration, difference-only charge or refund of the old price. The first grant arrives after payment, followed by grants 7, 14 and 21 days later. Previously paid grants, balances and expiry dates remain unchanged. Failed payment keeps the old plan. A scheduled cancellation remains in effect after upgrading.

Downgrade

Nothing is charged when you schedule a downgrade. Your current plan continues until the next renewal, when the new full monthly price applies. You can cancel the change before it takes effect; cancel it before requesting another change. If cancellation is scheduled, resume automatic renewal first.

Rejoin the same plan

Resuming the same plan during a paid period does not charge you, add photos, or extend the period. Regular monthly billing resumes at the original end date. Existing grants and photo expiry dates remain unchanged. After the paid period ends, or when starting a different plan, a new period starts after payment.

Cancel automatic renewal

Open plan changes in Purchases, proceed to cancellation and confirm. Future renewals stop; grants for purchased periods continue. Monthly photos remain usable until 30 days after their corresponding paid period ends. One-time packs expire 6 months after purchase; previously unlimited balances never expire. Cancel a free trial before it ends to avoid a charge; free photos expire at the original trial end.

Cancel a checkout or scheduled change

Comparing plans and requesting a quote are free. Canceling an unpaid checkout creates no charge for that checkout. Closing the page does not cancel or refund a completed payment. Canceling a downgrade reservation only removes that change; it does not cancel your current subscription or stop renewal.

Plan changes are unavailable during a free trial, while unpaid, or while another change awaits payment. Quotes are valid for 10 minutes. Rejoining never grants another free trial.

If a downgrade is scheduled, cancel that scheduled change before canceling your subscription.

5. Your Content and Generated Images

  • You retain all rights to the photos you upload.
  • You retain all rights to the images we generate for you. You may use them for personal or commercial purposes.
  • We do not use your uploaded or generated images to train AI models.
  • AI-generated images may inadvertently resemble third-party works or persons. We do not warrant non-infringement and you assume responsibility for how you use the output.

6. Prohibited Uses

You must not:

  • Upload photos of anyone other than yourself, or photos of any person without their consent.
  • Generate or attempt to generate sexual or explicit content involving minors.
  • Generate images intended to impersonate real public figures or to deceive others about identity.
  • Use the Service for any illegal purpose, including fraud, harassment, defamation, or non-consensual intimate imagery.
  • Attempt to reverse-engineer the Service, scrape the Service in bulk, or perform load attacks.
  • Resell credits or access to the Service to third parties.

Violations may result in immediate account suspension without refund.

7. Third-Party Compliance

The Service generates images you may upload to dating apps. Each dating app has its own rules about edited or AI-generated photos. You are responsible for compliance with those rules.

8. Disclaimers

  • The Service is provided "as is" without warranty of any kind.
  • We do not guarantee likeness fidelity, image quality, or specific outcomes.
  • Generation may be denied by upstream providers (e.g., OpenAI's content policy).

9. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the amount you paid for credits in the three (3) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

10. Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable for any damages resulting from such changes.

11. Account Termination

You may close your account at any time from My Page. Closing your account permanently deletes your registration data, generation history, and remaining credits. Remaining credits are not refunded on account closure.

12. Changes to These Terms

We may update these Terms when we change the Service. Updates take effect when posted on this page.
